Open Question: About to get evicted with 5 month old baby.....?

Open Question: Employer Went Bankrupt, What Can I Do?

Hi, I used to work for a company that went out of business and they didnt pay me for the final month that I worked. The owner has filed for bankruptcy and we agreed on May 30th,2008 that he was gonna sell the left over inventory to pay me off. Well its been over a month and I havent seen a dime, he has sold some inventory but everytime I call he tells me he needed the money for HIS bills. My example is the case of Miranda, Miranda vs. Arizona, in which the suit was filed that made it LAW that every police officers taking someone into custody have to "read them their rights" basically this is the right to remain silent, anything you say can and WILL be used against you in a court of LAW, you have the RIGHT to an attorney, if you can not afford and attorney one will be appointed to you. IN 2000 the SUPREME COURT overturned this law after 34 years! NOW cops do NOT have to warn you of your rights! THIS was stripped from the people. I am looking forward to each of your examples of compromised rights> YOUR welcome to GOOGLE it, if you are super young don't bother answering but YES we LOST this right, NOW the younger generation is getting incarcerated and NOT knowing of their rights! Look up Miranda vs Arizona then google 2000 Supreme Court Decision overturning Miranda vs. Arizona! Open Question: can i back out of a contract for a coop apartment after discovering changes to it after it has been signed?

I just signed a contract for a 2 bedroom coop in queens and my attorney did not divulge to me the full financial details of the coop prior to signing it. I found out, when submitting my documents to the coop board, that the copy of the contract submitted to the coop board was not the original one that I had signed previously. I was not given a copy of what I signed with the lawyer and there were numerous changes to the contract that were not there during the signing and I discovered that there was an assessment fee for a newly installed elevator which was not divulged to me by the realtor nor by the attorney. I want to back out of the contract and receive my 10% down payment back.

the plantiff (which is me) represented themself and the defendant had attorneys to the point the defendants attorney's persuaded the judge into believing jurisdiction was in the defendants state instead of the state I opened the case in? I was awarded a ten-year permanent injunction against him and have a divorce attorney. The injunction judge granted me sole custody and he can only look our 8-year-old son below supervision of a CJC. During our marriage (Florida) of nine years, I worked two jobs most of the time because he refused to find work and was high a lot of the time so he could not receive past drug screens. Now I learn he's going to try to receive alimony from me. My attorney said it won't happen because of the abuse, but I'm still worried and would like to know if anyone else here has experienced the same thing and your results.

I'd like to file for divorce. I live in arizona, Want to file in Florida. I have circumstances that guide me to believe I may be able to file a motion for inconvenient forum and have it granted so that I may file in Florida without meeting the residency restrictions. Open Question: Can a mortgage company or it's bank back out of a contract 6 days after it has closed?

My husband and I closed on a home on June 25, 2008. On July 1, 2008, the bank that funded the loan called and requested every of the money back because they said that my husband had signed in my place and he wasn't supposed to. I had given him full Power of Attorney, which he had gift at closing and was accepted by the title company. After the title company had already sent back the funds, they finally called me and let me know that the loan was pulled back. I then explained to them that my husband had the power of attorney and they claimed that they didn't know. Well, they said that it was their mistake but we would have to re-close and sign more paperwork. In the mean time, my contract has run out with the seller and he has received a bigger offer from someone else. Is that legal for them to even back out 6 days after closing paperwork was signed even when there was nothing truely wrong with the paperwork and then say oops, we are sorry? Since my credit has been checked 6 times by this mortgage company, my credit score has gone down by 40 pts and it is now going to be twice as difficult to find a lender to approve my loan. We had already moved out of our old home and into our new home when I received this phone call. We had a u-haul still full of our belongings. I have a 3 month old baby and they put us every out on the streets!!! It is 4th of July weekend and there is no hotels or cabins availiable. Can I sue them for personal injury if nothing else?

Recently my home was foreclosed on in February, I also had a second mortgage with the same company, apparently one didn't talk to the other. My husband passed away this year in May. Now the second mortgage company which is the same as the 1st mortgage is trying to collect. Since there is no more collaterol for the second mortgage, do I have to pay that loan as well. Open Question: Avoid points being assessed to my drivers license??!?!?

Hi there ya'll, I live in Tempe ,Arizona. I ran a red light and got into an accident.( got confused with the signal...not because i didnt look it) I have a Virginia drivers license. The cop told me points would be assessed to my drivers license. Can AZ MVD really take points off my VA drivers license? Do you think a Lawyer/Attorney can help? Please let me know and please help !!!!!!!!!!!!!!!!!!!!!!!!!... I ve never been in a situation like this. Plzz plzz help....im scared !!!!!!!!!!!!!!!!!!!!!!!!!...

Open Question: I recently filed in FL chpt 7 bankruptcy due to my home & the trustee stated a request to dismiss for abuse?

After speaking w SEVERAL lawyers, my CPA & real estate agents it was determined that my adjustable rate mortgage & $15K in credit debt soon to be followed with $40K repayment in student loans....bankruptcy is my best bet especially with the possibility of a deficiency judgment. My lawyer advised chpt 7. My student loans are not involved but my home which is $70K neg in equity & debt is. Went to court and the trustee felt my debt was not bad &since I make $42K a yr I should file chpt 13. She, I dont believe, knows that my student loan debt is due in 5 weeks as my attorney didnt include that on the worksheet nor did my attorney say anything when this trustee was tearing me apart. Question is if the courts dismiss my case what happens next? Bankruptcy is already on my credit report...does that arrive off? Will creditors that I am now MONTHS behind on settle at a lower amount and set up a payment plan or just harass me? I feel I am in a worse spot then I was before I started this process

Open Question: Do i have to send my exhusband papers on adoption from step-father?

My ex husband- the biological dad of my son, recently relinquished every rights...this is so that he did not have to pay the $40,000 in child support. Since this time my husband, who has raised my son since he was 4 years old stepped up and adopted him. I am now getting paperwork requesting that I send coopies of documentation to my ex-husbands attorney. Do I need to do this?

Open Question: An at will employee (paralegal) blows the whistle?

If a paralegal who is an at will employee blows the whistle on an unethical act an attorney committed is it legal for the attorney to flame the paralegal or would they be protected by the whistle blowers act?

Open Question: Will any attorney or lawyer be able to help this situation?

My car broke while driving, for this reason I went through a red light, I was in the hospital for about 6 months there after so I missed my court appearance, my bail,ticket +missed appearances amounted up to $1,000. So when I did appear, I brought the medical records + the work order on the car to show that it was COMPLETELY broken and at the time the breaks totally went out while I was driving. The judge kept every of my money and then gave me no point on my driving record and excused and dismissed the ticket. He still wanted the money so I went to pay it, then the court payment place said there computers were down that day to arrive back again to pay. I came back on the following Monday to pay, I got a ticket on the way over to the court home (which was also dismissed because the officer was found to be dishonest and I made no violation whatsoever) So I arrived and paid and there was a note on my file saying I refused to pay last time I was there. Then I had to deal with the second ticket I had to go through tons of driving, several court apearances waking up early in the morning to steer for hours there and hours back,becaue I do not live anywhere close either of these court houses PLUS I had ot take out loans to pay both tickets, I paid alot of gas money, also rented a cab for a lot of money for the many many times I had to appea and re-appear to these court houses, TONS of hours on the phone so extra phone cards were purchased, missed doctor's appointments, jeapardized my health conditon, and to this day I applied for car insurance and they said I was not eligible because I had a problem being reported to the DMV with my driving record so I called the court home and they said it was an mistake and that they would remove it out of their computer once and for every. This mistake should have been removed the day the second ticket was dismissed. So both tickets were dismissed due to the courts mistake and I was found to be innocent both times, but on the first time the judge kept my money and now they say it's too tardy to receive it back since this was a few months after thier appeal. I also spent about 5 weeks calling various departments and offices to figure out what the problem was on my dirving record and after several weeks and exhaustion and time I finally did. No one at the DMV could figure it out even. this is a TON of emotional distress. If I decided to file a suit who would I file it against?

Open Question: Could an attorney be sanctioned by a judge for appearing in court with a visible erection?

Not an EXPOSED erection, but one which was clearly visible in an outline through the attorney's pants. Assume it was beyond the attorney's control. The attorney had to stand up in court at the behest of the judge, but then everyone in the court saw his erection, and laughed. Could the judge sanction the attorney for something like this, even though it is involuntary on the attorney's part?
